Digi ’05

Terms of Use

Effective date: 2026-10-22

These terms are an agreement between you and Andrii Boiko (sole proprietor, Kyiv, Ukraine) (“we”) about the Digi ’05 apps for iPhone, Apple Watch, Android and Wear OS (the “App”). By downloading or using the App you accept them. If you got the App from the Apple App Store, Apple’s Licensed Application End User License Agreement also applies; if you got it from Google Play, the Google Play Terms of Service also apply. Where they conflict with these terms on store matters (payments, refunds, licence scope), the store terms prevail.

1. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for your own purposes. The App, its cameras, filters, design and code remain our property. You may not resell, rent or redistribute the App, or remove its notices.

2. Your photos

Your photos and videos are yours. We claim no rights to them and we never receive them: they are processed and stored on your device (see the Privacy Policy). Free exports carry a small “shot on Digi ’05” mark; Pro exports do not.

4. Acceptable use

Use the App lawfully. Respect other people’s privacy and the rules of places where you take photos. Do not use the App to harass anyone, to record people where it is prohibited, or to infringe anyone’s rights. Do not reverse engineer, modify or circumvent the App’s purchase checks, except where the law expressly allows it.

5. Availability and changes

We may update the App, change or discontinue features, or stop offering it. Updates may be needed to keep using the App. Cameras with a future release date are shown as previews until that date.

6. Disclaimer

The App is provided “as is” and “as available”. To the extent permitted by law, we give no warranty that it will be uninterrupted, error-free or suitable for a particular purpose. Keep backups of photos that matter to you.

7. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential losses, or for loss of data or photos. Our total liability for any claim relating to the App is limited to the amount you paid for the App in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law or your statutory rights as a consumer.

8. Governing law

These terms are governed by the laws of Ukraine. Disputes will be decided by the competent courts of Kyiv, Ukraine. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence and may bring claims in its courts.

9. Changes to these terms

We may update these terms. We will publish the new version on this page with a new effective date. Continued use of the App after a change means you accept the updated terms.
